El interés por los derechos indígenas es nuevo en el constitucionalismo latinoamericano que no se había preocupado por ellos hasta finales del siglo pasado. En las últimas décadas del siglo pasado, se han modificado numerosas Constituciones de Estados latinoamericanos que al tiempo que refuerzan los poderes presidenciales, consolidan los compromisos sociales del Estado, incluyendo en estas reformas la relación entre estos y los derechos indígenas. En este texto se estudia el constitucionalismo social hace posible el reconocimiento legal del sujeto colectivo indígena, los derechos prestacionales que el Estado debe a este colectivo, y el desarrollo de políticas intervencionistas en favor de derechos sociales de la población indígena. En este sentido se ha hablado del indigenismo integracionista como manifestación del nuevo constitucionalismo indigenista en Latinoamérica.
The interest in indigenous rights is new in Latin American constitutionalism, which had not been concerned about them until the end of the last century. In the last decades of the last century, numerous Constitutions of Latin American States have been modified that, while reinforcing presidential powers, consolidate the social commitments of the State, including in these reforms the relationship between these and indigenous rights. This text studies social constitutionalism that makes possible the legal recognition of the indigenous collective subject, the benefit rights that the State owes to this group, and the development of interventionist policies in favor of the social rights of the indigenous population. In this sense, integrationist indigenism has been spoken of as a manifestation of the new indigenist constitutionalism in Latin America.
