Jurisprudencia constitucional en materia penal y derecho a una sentencia en un plazo razonable

Abstract

Eleven years have passed and the Constitutional Court has not yet issued a judgment on the appeal of unconstitutionality filed against O.L. 2/2010, of March 3, not being the only recent case of significant delay in criminal matters. Using as a common thread the cases of the abortion law and the reviewable permanent imprisonment, this paper studies the content of the right to a judgment within a reasonable time (art. 6.1 ECHR), especially when the delays take place within the Constitutional Court itself. It analyses thecriteria to be followed to consider a delay as undue, the question of the application of Article 6.1 ECHR to the constitutional jurisdiction, the normative formulation, national and supranational, of this right, as well as the margin that a Constitutional Court has, based on its dual jurisdictional and political nature, to temper its resolutions to the political times and to its own conception of what should be itspeacemaking function and guarantee of the rights of minorities.

Después de once años el Tribunal Constitucional todavía no había dictado sentencia sobre el recurso de inconstitucionalidad interpuesto contra la L.O. 2/2010, de 3 de marzo (Ley del aborto). Utilizando como hilo conductor los recursos de inconstitucionalidad presentados contra esta Ley y sobre la prisión permanente revisable, que fue otro caso de demora significativa del Tribunal Constitucional, se estudia en este trabajo el contenido del derecho a una sentencia en un plazo razonable (art. 6.1 CEDH), en particular cuando las dilaciones tienen lugar en el seno del propio Tribunal Constitucional. Se analiza el margen de que dispone un Tribunal Constitucional, partiendo de su doble naturaleza jurisdiccional y política, para atemperar sus resoluciones a los tiempos políticos y a su propia concepción sobre el alcance de su función pacificadora y de garante de las minorías.
