A partir de la premisa de la separabilidad del contrato y del acuerdo de arbitraje, el presente estudio aborda, desde una perspectiva comparada, la determinación de la ley aplicable a la validez del acuerdo de arbitraje en las transacciones internacionales. Se deslinda a estos efectos la validez formal y la validez sustancial, se pone de relieve la divergencia de las distintas aproximaciones existentes a tales cuestiones en las legislaciones nacionales y en los reglamentos institucionales y se delimita el ámbito de aplicación de la ley rectora de la validez formal y sustancial de los acuerdos de arbitraje.
Based on the premise of separability of the contract and the arbitration agreement, this article deals with the determination of the law applicable to the validity of arbitration agreements in cross-border transactions. A distinction is made between formal validity and substantial validity. Divergences among national legislations and institutional regulations are also highlighted. Finally, the sphere of application of the law governing both formal and substantial validity is delimited.
