Derechos reales en el Derecho Romano

Abstract

Este trabajo muestra de manera general y sistemática las instituciones jurídicas que forman parte de los Derechos Reales. En concreto. se estudia la concepción jurídica de la expresión "cosa" u "objeto del Derecho", analizando los distintos tipos o clasificación de cosas que pueden estar o no en el patrimonio de una persona. Se menciona la diferencia y conexión que se establece entre la "propiedad" y la "posesión", así como las distintas instituciones jurídicas que forma los conocidos como "iura in re aliena". Concretamente, se realiza la exposición de las servidumbres prediales (rústicas y urbanas) y personales (usufructo, uso, habitación y "operae servorum") y el derecho de enfiteusis y el de superficie. Concluimos con el desarrollo de los derechos reales de garantía, analizando las instituciones de la fiducia, prenda e hipoteca.

Thes work shows in a general and systematic way the legal institutions that are part of the Royal Law. In particular, the legal conception of the term "thing" or "object of the right" is studied, analyzing the different types or classification of things that may or may not be in a person's estate. It mentions the difference and the connection that is established between "ownweship" and "possession", as well as the different legal institutions that make up those known as "iura in re aliena". Specifically, the exhibition of the predial (rustic and urban) and personal easements (usufruct, use, room and "operae servorum") and the right of enfiteusis and surface. We conclude with the development of real collateral rights by analyzing the institutions of trust, pledge and mortage.
