Abstract

El fundamento del tema elegido reside en la importancia de todo fenómeno de extinción unilateral, que de hecho puede darse en cualquier tipo contractual y su deficiente regulación legal, ya que la figura no esta regulada con carácter general en el código civil y ha sido escasamente tratada por la doctrina española, por lo que ha sido necesaria una constante referencia al código civil relativo a las legislaciones extranjeras, haciendo hincapié de forma especial en la francesa, por su paralelismo con la española y en la italiana por ser esta última la que más clara y abundantemente puede ilustrarnos sobre las perspectivas actuales de nuestra figura en derecho español, así como sobre la evolución de sus caracteres.
