Presupuesto y parlamentarismo: la aportación del presupuesto a la formación del parlamentarismo continental europeo

Abstract

El presente trabajo analiza la imbricación del concepto “moderno” de Presupuesto con el sistema parlamentario de Gobierno, tomando como punto de partida el origen del Presupuesto y de las prácticas del régimen parlamentario en Gran Bretaña, en el contexto del nacimiento y desarrollo del Estado constitucional y su adopción a uno y otro lado del Atlántico. Una vinculación inicial entre el nacimiento del Estado constitucional y la adopción del concepto “moderno” de Presupuesto que se plasma jurídicamente en las primeras Declaraciones de Derechos, para concretarse, durante la vigencia de las Cartas constitucionales francesas de 1814 y 1830, cuando se recibe de nuevo la experiencia constitucional inglesa en el continente europeo, en una estrecha imbricación entre la incorporación de las prácticas del sistema parlamentario de gobierno y las cuestiones políticas relacionadas con el Presupuesto del Estado, hasta el punto de que cuando se produce la racionalización del sistema parlamentario de gobierno en el período de entreguerras, también tiene lugar la incorporación de los principios presupuestarios a los Textos Constitucionales, en cuyo contexto se desarrolla la particular experiencia de la Constitución española de 1931, donde se diferencia constitucionalmente entre Presupuesto del Estado y Ley de Presupuestos, con el fin de sustraer al primero de la sanción y promulgación por el Jefe del Estado.

This paper analyzes the relationship between the 'modern' concept of budget and the parliamentary system of Government, taking as starting point the origin of the budget and the practices of the parliamentary regime in Britain, in the context of the birth and development of the constitutional State and its adoption to one across the Atlantic. An initial bonding between the birth of the Constitutional State and the adoption of the "modern" concept of budget that is legally embodied in the first Bill of Rights established both in England and in the American Colonies, that arrives to the European continent during the term of the French Constitutional Charters in 1814 and 1830, when the English constitutional practices on parliamentary system of government are received. The rationalization of the parliamentary system of government in the interwar period, also takes place the incorporation of the principles of the budget to the constitutional texts, in the context of which develops the particular experience of the Spanish Constitution of 1931, which introduce the difference between the State budget and the budget Act, in order to evade from the first mentioned document the sanction and promulgation by the Head of State.
