Abstract

Hasta el año 2000 la regulación de los servicios de inteligencia era dispersa y se regulaba por normas inferiores a la ley. Faltaba una ley que determinara sus funciones y los sometiera a los controles parlamentarios y judiciales que exige el Estado de Derecho. No obstante, la nueva regulación (Ley 11/2002 y LO 2/2002, de 6 de mayo) tampoco está exenta de lagunas y los interrogantes siguen planteándose. ¿Qué funciones corresponden a los servicios de inteligencia y cuáles son de la policía? ¿Contiene la nueva legislación algún elemento de discutible constitucionalidad? ¿Qué modelos extranjeros ha seguido nuestro legislador y por qué? ¿Cómo se conservan y destruyen los datos que obran en poder del Centro Nacional de Inteligencia? ¿Qué duración pueden llegar a tener las intervenciones de los servicios de inteligencia? ¿Cómo se salvaguarda el derecho de defensa de las personas investigadas? ¿Alcanza la garantía judicial solamente a las intervenciones en el domicilio y en las comunicaciones? ¿Y si la información que se necesita se encuentra en otro sitio? ¿Qué deben hacer los servicios de inteligencia cuando en el curso de una investigación descubren la existencia de un delito? ¿Qué problemas presenta el sistema de control por parte del Parlamento? Los principales servicios de inteligencia son también estudiados: la CIA, el MOSAD, los servicios británicos y franceses, así como las categorías constitucionales y los tipos penales implicados en la actuación de los servicios secretos. Todo ello dentro de un complejo comentario sobre la nueva legislación.

Until 2000 the regulation of the intelligence services was dispersed and lower standards regulated by the law. Lacked a law to determine their duties and submit to parliamentary and judicial controls required by the rule of law. However, the new regulation (Law 11/2002 and Law 2/2002 of 6 May) is not without gaps and questions continue to arise. What features are intelligence and what are the police? Does the new legislation some element of questionable constitutionality? What foreign models has followed our legislature and why? How do you retain and destroy data held by the National Intelligence Center? How long can have assistance from the intelligence services? How to safeguard the rights of defense of persons under investigation? Is it sufficient judicial guarantee only at home interventions and communications? What if the information needed is in another site? What should the intelligence services when in the course of an investigation discover the existence of a crime? What problems does the control system by Parliament? The main intelligence services are also studied: the CIA, the Mossad, British and French services, and the types constitutional and criminal types involved in the activities of the secret services. All this within a complex commentary on the new legislation.
