This paper offers an analysis of the invocation of the clean hands principle in investment arbitration and its effects on the jurisdiction of the arbitral tribunal, the admissibility of the claim or its treatment of an issue on the merits, addressing the different variables to be taken into account: whether the obligation to respect the legality of the host state is expressly contemplated in an investment protection treaty or not; whether the illegal conduct on the part of the investor occurs at the time of the establishment of the investment or, subsequently, during its development or execution; finally, the determination and incidence of the seriousness of the infractions committed by the investor
