Abstract

El presente trabajo aborda, desde una perspectiva crítica y propositiva, la problemática laboral derivada de la externalización o subcontratación de servicios tanto en el sector privado como en el ámbito de las Administraciones públicas. A partir de un análisis normativo, doctrinal y jurisprudencial, se examinan los factores que hacen de la externalización un mecanismo estructural de precarización del empleo y se proponen reformas lege ferenda orientadas a la igualdad material de condiciones laborales, al refuerzo de los mecanismos de responsabilidad a lo largo en la cadena de contratas y la construcción de un modelo de externalización productiva socialmente responsable.

This paper addresses, from a critical and constructive perspective, the labor issues arising from outsourcing or subcontracting of services, both in the private sector and within public administrations. Through a normative, doctrinal, and case law analysis, it examines the factors that make outsourcing a structural mechanism for employment precarization. The study also proposes lege ferenda reforms aimed at achieving substantive equality in working conditions, strengthening liability mechanisms throughout the contracting chain, and building a socially responsible model of productive outsourcing.
