Abstract

El presente trabajo tiene por objeto el análisis y la valoración crítica de la doctrina de la Dirección General de Seguridad Jurídica y Fe Pública sobre los acuerdos de los cónyuges relacionados con la atribución de carácter privativo a los bienes que adquiere uno de ellos a título oneroso bajo el régimen de gananciales y de cara a la inscripción de dichos bienes en el Registro de la Propiedad. Las resoluciones de 12 de junio de 2020 y otras posteriores que siguen su misma orientación han constituido un punto de inflexión importante en esta materia, en la que se encuentran involucradas cuestiones de envergadura en el ámbito familiar y patrimonial como el alcance de la autonomía de los cónyuges, la expresión de la causa de los negocios jurídicos, la protección de los acreedores y legitimarios frente a los negocios realizados por los esposos y los requisitos legales para inscribir los bienes de las personas casadas en régimen de gananciales

The aim of this work is to analyse and critically assess the doctrine of the Spanish General Directorate of Legal Security and Public Faith on the spousal agreements related to the exclusive titledeed conventional allocation of assets acquired by an onerous title by an spouse for official record in the Property Registry. Resolutions on this topic published from 12 June 2020 onwards may well be consiedered as a turning point. These involve highly important questions concerning the field of family and patrimonial assets such as the accomplishment of spouse autonomy, the expression of the cause of legal business, the protection of creditors and forced heirs when an spouse starts legal business and the legal requirements to register assets of married persons under community of property regime.
