Abstract

La omnipresencia de Internet y de productos y servicios basados en la IA han construido un nuevo escenario relacional a nivel socioéconómico y, con ello, un nuevo marco de ejercicio y tutela de los derechos fundamentales de las personas, caracterizado en gran medida por el tratamiento masivo de datos personales. Los menores de edad no escapan a los riesgos de esta realidad, en un entorno que se digitaliza cada vez más y a edades más tempranas. Por ello, en este trabajo se analiza con detalle el tratamiento de los datos personales de menores de edad, con especial atención a las especialidades relativas a la capacidad y legitimación para consentir su tratamiento, así como al análisis de los supuestos más habituales de tratamiento de datos personales de menores de edad. Especial atención se presta al ámbito escolar y al sanitario.

The omnipresence of the Internet and of AI-based products and services has created a new relational scenario at the socioeconomic level and, with it, a new framework for the exercise and protection of individuals’ fundamental rights, largely characterized by the massive processing of personal data. Minors are not exempt from the risks of this reality, in an environment that is becoming increasingly digital and at ever younger ages. Therefore, this paper provides a detailed analysis of the processing of minors’ personal data, with special attention to the specific aspects related to their capacity and legal standing to consent to such processing, as well as an examination of the most common cases of personal data processing involving minors. Particular attention is given to the educational and healthcare sectors.
