El despido colectivo

Abstract

En la racionalidad funcional expresada a través de la eficiencia y la optimización de los resultados económicos, teniendo en cuenta el papel hermenéutico e interpretador de los jueces y tribunales, en ese conflicto existente dentro del marco normativo legal que posee cierta “maleabilidad” (lo que hace que en el razonamiento aplicativo judicial puedan aparecer elementos de inseguridad jurídica), realizamos un profundo estudio –doctrinal y judicial– sobre la figura jurídica del despido colectivo con la intención de referenciar todas las carencias e insuficiencias que la propia normativa puede generar. Desarrollamos así un análisis de la diversa y heterogénea problemática que presenta el marco jurídico-positivo sobre el despido colectivo como mecanismo extintivo del contrato de trabajo a través de una categoría sui generis de alteración sobrevenida de circunstancias. Como contraprestación, el propio ordenamiento jurídico constituye y ordena una serie de garantías y formalidades dentro de un procedimiento muy técnico y complejo. Todo ello marcado por la rigurosidad. Por tanto, desde reflexiones analíticas, profundas y propositivas, se está ante un análisis actual y pormenorizado de las elaboraciones de la doctrina científico-jurídica, de las normas reguladoras y del derecho judicial –en su conjunto– con el que dar respuesta a todas las complicaciones que pueden surgir en el despido colectivo.

In the functional rationality expressed through efficiency and the optimisation of economic results, taking into account the hermeneutic and interpretative role of judges and courts, in this existing conflict within the legal regulatory framework that has a certain ‘malleability’ (which means that elements of legal insecurity can appear in the judicial reasoning applied), we carried out an in-depth study -doctrinal and judicial- on the legal figure of collective dismissal with the intention of referencing all the shortcomings and insufficiencies that the regulations themselves can generate. We thus develop an analysis of the diverse and heterogeneous problems presented by the legal-positive framework on collective dismissal as a mechanism for terminating the employment contract through a sui generis category of supervening alteration of circumstances. In return, the legal system itself establishes and orders a series of guarantees and formalities within a highly technical and complex procedure. All of this is marked by rigour. Therefore, from analytical, profound and proactive reflections, we are faced with a current and detailed analysis of the elaborations of the scientific-legal doctrine, of the regulatory norms and of judicial law -as a whole- with which to respond to all the complications that can arise in collective dismissal.
