La huida del proceso civil

Abstract

Desde que entró en vigor la Ley de Enjuiciamiento Civil al inicio del milenio las sucesivas reformas han ido dificultando el acceso al proceso civil, bien a través de los llamados métodos alternativos de resolución de conflictos (arbitraje, mediación y conciliación), bien mediante restricciones directas (tasas judiciales, dificultad de acceso a los recursos judiciales, etc.). Se propone una reflexión sobre la dirección de las políticas neoliberales en materia de justicia, así como su consideración desde la ciencia del derecho procesal a través de la función jurisdiccional y el derecho a la tutela judicial efectiva, ambos parámetros consagrados en la Constitución española de 1978. El presente estudio reivindica el proceso judicial como el medio de resolución de conflictos más perfeccionado y con mayores garantías para la protección de los derechos frente al interés aparente por reducir la sobrecarga de los tribunales civiles.

Since the Civil Procedure Law came into force at the beginning of the millennium, successive reforms have made access to the civil process more difficult, either through the so-called alternative methods of conflict resolution (arbitration, mediation and conciliation), or through direct restrictions (court fees, difficulty of access to judicial resources, etc.). A reflection on the direction of neoliberal policies in the matter of justice is proposed, as well as its consideration from the science of procedural law through the jurisdictional function and the right to effective judicial protection, both parameters enshrined in the Spanish Constitution of 1978 . The present study vindicates the judicial process as the most advanced means of conflict resolution and with greater guarantees for the protection of rights against the apparent interest in reducing the overload of civil courts.
