La comunicación en el proceso civil

Abstract

Este capítulo analiza la importancia de la comunicación oral en el proceso civil desde una perspectiva práctica y docente. El autor, con experiencia en la abogacía y la universidad, destaca que una intervención eficaz requiere dominio del lenguaje, conocimiento profundo del caso y preparación estratégica de las vistas. Se subraya la necesidad de argumentar con claridad, evitar la lectura literal y cuidar tanto la expresión verbal como la no verbal. Además, se abordan aspectos como la preparación de testigos, el uso del tiempo y la interacción entre oratoria, prueba y estrategia procesal. La obra concluye que la oralidad, lejos de ser un mero trámite, es una herramienta esencial en la práctica procesal civil.

This chapter explores the role of oral communication in civil proceedings from both a practical and academic standpoint. Drawing on legal and teaching experience, the author emphasizes that effective courtroom performance requires mastery of language, thorough case knowledge, and strategic preparation. Key elements include clear argumentation, avoiding verbatim reading, and attention to both verbal and non-verbal expression. The chapter also discusses witness preparation, time management, and the interplay between oratory, evidence, and procedural strategy. It concludes that oral advocacy is not a formality but a vital tool in civil litigation practice.
