Abstract

En nuestro trabajo, analizamos de forma exhaustiva los pros y contras de la implantación en nuestro ordenamiento jurídico de la ADCF por el aprobado Proyecto de Ley de 2023 — como transferencia de resultado de lo mandatado por la disposición adicional primera de la Ley 7/2017, de 2 de noviembre, por la que se incorpora al ordenamiento jurídico español la Directiva 2013/11/UE, de 21 de mayo, relativa a la resolución alternativa de litigios en materia de consumo en aras de «garantizar a los consumidores residentes en la Unión Europea el acceso a mecanismos de resolución alternativa de litigios en materia de consumo que sean de alta calidad por ser independientes, imparciales, transparentes, efectivos, rápidos y justos» (artículo 1.1 de la Ley 7/2017)— como única entidad acreditada para resolver los conflictos entre los clientes consumidores financieros y las entidades financieras. Analizamos y valoramos la iniciativa legislativa española, díscola respecto a los países de su entorno europeo, de crear un órgano administrativo-judicial, pretendidamente independiente, encargado de proporcionar una vía alternativa para la resolución de conflictos financieros

In our work, we exhaustively analyze the pros and cons of the implementation in our legal system of the ADCF by the approved Bill of 2023 — as a transfer of the result of what is mandated by the first additional provision of Law 7/2017, of November 2, which incorporates into the Spanish legal system Directive 2013/11/EU, of May 21, relating to the alternative resolution of consumer disputes in order to «guarantee consumers residing in the Union European Union access to alternative resolution mechanisms for consumer disputes that are of high quality because they are independent, impartial, transparent, effective, fast and fair» (article 1.1 of Law 7/2017) — as the only entity accredited to resolve conflicts between financial consumer clients and financial institutions. We analyze and evaluate the Spanish legislative initiative, inconsistent with its European surrounding countries, to create an administrative-judicial body, supposedly independent, in charge of providing an alternative way to resolve financial conflicts
