Abstract

Esta obra, basada en la tesis doctoral del autor, y que fue calificada sobresaliente cum laude, realiza un estudio jurisprudencial de los principales aspectos jurídicos controvertidos de los delitos urbanísticos recogidos en el artículo 319 CP. Como ha señalado el Tribunal Supremo, en el urbanismo se encierra el equilibro de las ciudades y de los núcleos de población, e incorpora el equilibrio físico y psíquico de las personas que viven en ellas. Se analiza el sujeto activo de estos delitos, centrando el estudio en la definición realizada por el Tribunal Supremo de promotor, constructor y técnico director. El objeto material, la consumación, y los demás elementos configuradores del delito se analizan siempre desde supuestos concretos y a la luz de la jurisprudencia reciente. Se abordan cuestiones de gran relevancia como el alcance del concepto no autorizable, y como afectan las modificaciones ulteriores de planeamiento al tipo penal. Además, se analizan otras cuestiones como el tercero de buena fe o la demolición de la obra ilegal.
