Abstract

Con la regulación de los procedimientos urgentes, el Anteproyecto de Ley de Enjuiciamiento Criminal de 2020 pretende conseguir una justicia acelerada respecto de infracciones penales menos graves cuya investigación se prevea rápida. Se opta por concentrar la fase de investigación y la intermedia durante el servicio de guardia. Además, en los supuestos de comisión de ciertos delitos, caracterizados por la objetividad de sus elementos típicos, se intensifica la agilidad mediante la celebración inmediata del juicio oral. Los objetivos principales de este trabajo consisten en exponer los aspectos claves de los procedimientos urgentes, observar las diferencias más relevantes con el vigente procedimiento para el enjuiciamiento rápido de determinados delitos y valorar algunas de dichas diferencias.

With the regulation of urgent procedures, the Draft Bill on Criminal Procedure of 2020 aims to achieve accelerated justice with respect to less serious criminal offenses whose investigation is expected quickly. It is decided to concentrate the investigation and the intermediate phases within the guard duty. In addition, in the cases of commission of certain crimes characterized by the objectivity of their elements as statutorily defined, agility is intensified by the immediate holding of the trial. The main objectives of this paper consist of exposing the crucial aspects of the new proposed urgent procedures, observing the most relevant differences with the current speedy trial established under the applicable Criminal Procedural Law and assessing some of them.
