Freedom of testation is deemed to be an essential principle of the modern law of successions. Freedom of testation not only covers the freedom to make a will or not, but also the freedom to decide its content. Among this content, freedom to impose conditions to successors becomes especially relevant, since it can affect the freedom and the fundamental rights of the successors. This paper, taking profit of the comparative experience, analyses, in the first place, testamentary conditions restricting freedom to marriage, religious freedom and other freedoms, and, in the second place, conditions affecting the right to equality and the right not to be discriminated.
La libertad de testar se considera un principio fundamental del derecho de sucesiones moderno. No solo contempla la libertad para otorgar testamento o no, sino también para decidir su contenido, entre el que se incluye la libertad para imponer condiciones a los sucesores. Sin embargo, esta libertad del testador puede afectar la libertad e incluso los derechos fundamentales de los sucesores. El artículo, usando la experiencia comparada, analiza el fenómeno de las condiciones testamentarias impuestas a los sucesores, en primer lugar las que afectan a sus libertades, y en segundo lugar las que conciernen al derecho a la igualdad y a la no discriminación.
