Este trabajo analiza como los órganos judiciales han acudido a la Directiva 2000/78, de 27 de noviembre, del Consejo, por la que se establece un marco general para la igualdad de trato en el empleo y la ocupación como una posible vía para evitar los efectos no deseados de la configuración actual del despido del trabajador por sus ausencias al trabajo.
This paper analyzes how Spanish courts have applied Council Directive 2000/78/EC of 27 November 2000 establishing a general framework for equal treatment in employment and occupation as a way to avoid the unwanted effects of the current configuration of the dismissal of the worker due to absences from work.
