Abstract

Le présent article soutient que les systèmes de licences négociables peuvent être utilisés comme des instruments de régulation environnementale et permettre de la sorte que les bénéfices extérieurs générés par la mise en place de nouveaux espaces naturels soient internalisés par les communautés les plus proches. La création d’un parc naturel implique non seulement des externalités positives, qui bénéficient des secteurs très larges de la société, mais aussi des coûts d’opportunité qui sont assumés en général par les communautés situées à proximité des nouvelles aires naturelles. La concession de licences négociables aux communautés titulaires des droits traditionnels d’exploitation de ces aires permet de compenser celles-ci économiquement sans perte financière ni diminution des droits d’exploitation acquis par lesdites communautés.

En este artículo se argumenta que los sistemas de licencias negociables pueden ser utilizados como instrumentos de regulación medioambiental permitiendo que los beneficios externos generados por la creación de nuevos espacios naturales sean internalizados por las comunidades cercanas a los mismos. La creación de un parque natural conlleva no sólo unas externalidades positivas, de las que se benefician amplios sectores de la sociedad, sino además unos costes de oportunidad que generalmente recaen en las comunidades cercanas a las nuevas áreas naturales. La asignación de licencias negociables a las comunidades depositarias de los derechos tradicionales de explotación de estas áreas permite que éstas sean compensadas económicamente sin merma económica ni de los derechos de explotación adquiridos por estas comunidades.

This article maintains that negotiable licence systems may be used as environmental regulation tools, allowing the external benefits of newly-created natural spaces to be internalised by nearby communities. The creation of a natural park does not only bring positive externalities benefitting large segments of society: it also gives rise to opportunity costs which are generally borne by the communities which are close to the new natural areas. By granting negotiable licences to the communities traditionally entitled to using those areas such communities can be compensated financially without undermining their economy or their historic rights of using the areas.
