Autoria e execução comparticipadas

Abstract

The control of the offence doctrine, as well as the theoretical approaches to the unitary systems of complicity, have come to reduce the dogmatic meaning of the distinction between perpetration and accomplice liability to a set of quantitative rules of balance of the importance of the contributions in the penalty’s measurement, sometimes with damage to the constitutional harm principle. A system of accessorial liability, as the Portuguese, requires, however, a typical delimitation criterion which qualitatively distinguishes the perpetrator from the accomplice, that can be controlled from the standpoint of the principle of legality. Based on a singular-restrictive concept of perpetrator and on the conception of the general regulations of perpetration as rules of imputation of the joint offence, this research reformulates the innocent agency and the joint perpetration as issues of objective imputation related to the objective unvalue of the action that express a specific modality of attack on the legally protected interests. One associates coherently commission and perpetration, on the one hand, and accessorial and accomplice liability, on the other hand. In this way, perpetration is distanced from the vague idea of the central figure of the criminal event and of the innacurate criteria of the control of the offence, to be identified with a typical connection of immediate risk, that is, with the possibility of direct endangerment of the legally protected interest and, therefore, with the beginning of the attempt and an immediate want and need of punishment. The perpetrator, unlike the accomplice, emerges, thus, as the one that does not necessarily depend on the externalisation of his unlawful action through another to overcome the edge of punishment for attempt. In this way, it is presented an adequate political-criminal reading of the Portuguese complicity model, as an alternative to the current main criminal doctrines, thus allowing a higher level of achievement of the harm principle, on the one hand, and, on the other hand, of the principles of equality, proportionality and guilt, that is, of the constitutional principles that rule the subjects of complicity and attempt.
