A sociedade, enquanto reunião de pessoas unidas pela origem ou por leis, enfrenta – aos dias de hoje – dramáticos desafios; em parte, diga-se, comuns aos problemas do Estado Social. Isto porque, como é bom de ver, as tensões entre o social e o individual são, cada vez mais, fonte de acérrimos conflitos e divisões. Se há, aos dias de hoje, uma tensão entre diversos modelos de Estado – Estado Liberal versus Estado Social – não menos verdade é que um dos pressupostos aglutinadores e definidores de uma sociedade enquanto tal; está, também ele ameaçado. Refiro-me, aqui, à sociedade enquanto “casa onde se reúnem as pessoas unidas por um interesse ou ideias comuns”. Disto isto, e independentemente de disputas político-ideológicas de matriz social (que têm toda a legitimidade e pertinência); ponto assente é o de que, por entre ruas e ruelas, é o cidadão – a Pessoa e o seu indissociável Direito à Saúde (bem como todos os demais Direitos de Personalidade)) – que tem de ser a força aglutinadora, a bússola norteadora e o sólido pilar sobre o qual se constrói uma sociedade e um regime que se pretenda saudável, produtivo e duradouro. E é sobre esse paradigma que, entendo, se deve estudar e consolidar a doutrina do Dano Corporal – ou seja, entendendo tais matérias enquanto princípio – em potência – omnipresente em todas as relações sociais/ interpessoais e enquanto verdadeiro esqueleto axial (e não apenas apendicular) da sociedade e do Direito. Diria até, num assumido Primado do Humanismo – filosoficamente considerado; não esquecendo que o Direito é o “conjunto de normas e princípios legais que regulam as relações dos indivíduos em sociedade”. Este é, pois, o genérico desígnio que – por via de revisão bibliográfica - se pretende abordar no presente Trabalho Final do Mestrado Integrado em Medicina; sendo que, em concreto, me debruçarei sobre algumas das matérias sempre inseparáveis e necessárias para a compreensão da temática do Dano Corporal, como seja a sociedade de risco e integridade corporal; a emergência e avaliação do dano corporal; consequências pecuniárias e não pecuniárias do Dano Corporal; entre outros (como seja o Dano Corporal em situações específicas).

Society, as a group of people united by origin or by laws, faces – nowadays – dramatic challenges; in part, let’s say, common to the problems of the Welfare State. This happens because, as it’s good to see, the tensions between the social and the individual are, more and more, a source of fierce conflicts and divisions. If there is, nowadays, a tension between different models of State – Liberal State versus Social State – no less true is that one of the unifying and defining assumptions of a society as such; is, itself, threatened. In here, referring to society as “a house where people united by a common interests or ideas, meet”. That said, and regardless of political-ideological disputes of a social matrix (which have all the legitimacy and relevance); common ground is that, through streets and alleys, it is the citizen – the Person and their inseparable Right to Health (as well as all other Personality Rights)) – who must be the unifying force, the guiding compass and the solid pillar on which to build a society and a regime that intends to be healthy, productive and lasting. And it’s on this paradigm that, I consider, the doctrine of bodily damage should be studied and consolidated – that is, understanding such matters as a principle – potentially – omnipresent in all social/ interpersonal relations and as a true axial skeleton (and not only appendicular) of society and law. I would even say, in an assumed Primacy of Humanism – philosophically considered; not forgetting that Law is the “set of norms and legal principles that regulate the relations of individuals in society”. This is, therefore, the generic purpose that – through a bibliographic review – is intended to be addressed in this final work of the Integrated Master in Medicine. To achieve that, I will specifically focus on some of the subjects that are always inseparable and necessary for understanding the theme of bodily damage, such as risk society and bodily integrity; the emergence and assessment of bodily harm; pecuniary and non-pecuniary consequences of bodily damage; among others (such as bodily damage in specific situations).
