Abstract

As normas internacionais do trabalho constituem instrumentos jurídicos elaborados pelos mandantes tripartidos da Organização Internacional do Trabalho (governos, empregadores e trabalhadores), e orientam os legisladores nacionais no aperfeiçoamento e promoção do direito do trabalho e das relações profissionais. No caso das Convenções são também tratados internacionais juridicamente vinculativos, sujeitos a ratificação por parte dos Estados-membros. Até à adaptação do ordenamento jurídico de um Estado-membro ao disposto numa Convenção, decorre um processo que inclui três fases principais: adoção, submissão e ratificação. Este processo é caracterizado por uma ampla discussão tripartida e conduz à universalização de princípios e direitos no trabalho, com particular destaque para os fundamentais, que contribuem para a prossecução dos direitos humanos.

International labour standards are legal instruments developed by the tripartite constituents of the International Labour Organization (governments, employers and workers), and guide national legislators in improving and promoting labour law and professional relations. In the case of Conventions, they are also legally binding international treaties, subject to ratification by the Member States. Until the legal system of a member state is adapted to the provisions of a Convention, a process that includes three main stages is underway: adoption, submission and ratification. This process is characterized by a broad tripartite discussion and leads to the universalization of principles and rights at work, with particular emphasis on the fundamental ones, which contribute to the pursuit of human rights.
