Abstract

A dissertação busca examinar as imunidades parlamentares e a sua interpretação em julgados de diversas Cortes Constitucionais, Supremas Cortes e no Tribunal Europeu de Direitos Humanos. Esclarece-se inicialmente as diversas terminologias adotadas, aborda-se o surgimento do parlamento e a transformação do mandato imperativo em representativo, efetuando-se uma breve análise do surgimento daquelas, delineando-se os conceitos de suas vertentes material e formal e as controvérsias nas suas concretizações. No tocante à primeira, discute-se seu âmbito de proteção tipos de responsabilização afastados e da possibilidade de controle, em âmbito interno e externo, além de definir sua natureza jurídica. Em relação à prerrogativa processual, faz-se exame de suas subspécies, quais medidas com ela não conflitariam, a sua coexistência com a prisão em flagrante delito e nesse compasso a sua amplitude, o procedimento para eventual levantamento da prerrogativa pela Casa Legislativa e se essa decisão pode ser submetida à revisão pelo Poder Judiciário, explorando os efeitos tanto da denegação quanto da concessão, assim como se aborda as medidas cautelares e a sentença definitiva diante da prerrogativa. Efetua-se, em seguida, uma análise da opinião doutrinária sobre a necessidade ou não de manutenção das prerrogativas no atual estágio do constitucionalismo, são descritas algumas tendências interpretativas ao redor do mundo e são expostos seus grandes dilemas na contemporaneidade. Por fim, identificam-se os direitos em potencial conflito com as imunidades parlamentares, faz-se uma digressão sobre aspectos da interpretação da Constituição e teorias sobre o controle de constitucionalidade, discorrendo-se sobre a atual concepção da Separação dos Poderes e o princípio Republicano para, ao final, construir a melhor forma de interpretação dos artigos constitucionais versantes sobre imunidades parlamentares

The dissertation seeks to examine parliamentary privileges and their interpretation in judgments of various Constitutional Courts, Supreme Courts and the European Court of Human Rights. Initially, the various terminologies adopted are clarified, the emergence of parliament and the transformation of the imperative mandate into a representative one are discussed, making a brief analysis of the emergence of those, outlining the concepts of their material and formal aspects and the controversies in their uses. Regarding the first, its scope of protection is discussed, types of liability removed and the possibility of control, both internally and externally, in addition to defining its legal nature. In relation to the procedural prerogative, its subspecies are examined, which measures would not conflict with it, its coexistence with the arrest in flagrante delicto and, in this measure, its amplitude, the procedure for eventual lifting of the prerogative by the Legislative House and if this decision can be submitted for review by the Judiciary, exploring the effects of both the denial and the concession, as well as the precautionary measures and the final sentence in face of the prerogative. Then, an analysis of the doctrinal opinion about the need or not of maintaining the prerogatives in the current stage of constitutionalism is carried out, some interpretive trends around the world are described and their great dilemmas in contemporary times are exposed. Finally, the rights in potential conflict with parliamentary immunities are identified, a digression is made on aspects of the interpretation of the Constitution and theories on judicial review, discussing the current conception of the Separation of Powers and the Republican principle. to, in the end, build the best way of interpreting the constitutional articles dealing with parliamentary immunities.
