The current growth of technology and the upgrading speed of information spreading provided a new sort of dynamic in the digital environment. Granted by the easy availability of access to content in the digital era, due to research tools on websites. For that, this accessibility of information reverberated in legal contours that propitiated the development of a new right, in the face of content that is harmful to the individual, the right to be forgotten. The consecration of this new institute has a notable impact on the international system. Although legal protection is present only in the member countries of the European Union, it has been triggered in volume as applicable and problematic about applications in other regions of the world. However, the Latin American and American context denotes and problematize the application of the institute, in which substantially differs from the European environment Through a comparative and exploratory methodology, starting from general forecasts and using reports, bibliographic materials, judgments and legislation, it is proposed to analyze the development of the institute in the European scope and possible application in these other two regions, with emphasis on the recent repercussions in the Brazilian case, in addition to identifying the problems and regional discussions on the subject. The study aims to show that the European and the American contexts have different positions on the subject, while the Latin American context presents not only legal, but social problems of an import of the European model under a conjuncture of viability of past information, although is a recent and controversial subject. Therefore, the application of the institute is envisaged through the respective characteristics inherent to the aforementioned regions.

O avanço da tecnologia e da difusão das informações, propiciaram uma nova dinâmica no ambiente digital, pela fácil disponibilização do acesso ao conteúdo indexado nos meios digitais, através dos sites de mecanismos de buscas. Para tanto, essa acessibilidade das informações reverberou em contornos jurídicos que propiciaram o surgimento de um novo direito, diante de conteúdos lesivos ao indivíduo, o direito ao esquecimento. A consagração desse novo instituto, tem um impacto notório no sistema internacional, ainda que a tutela jurídica se faça presente somente aos países-membros da União Europeia, contudo, proporcionam discussões e problemáticas acerca da aplicação em outras regiões do mundo. Não obstante, o contexto latino-americano e o estadunidense parecem-nos ter discussões e problemáticas à aplicação do instituto, que diferem substancialmente do ambiente europeu. Através de uma metodologia comparativa e exploratória, partindo de previsões gerais e utilizando-se de relatórios, materiais bibliográficos, julgamentos e legislações, propõe-se analisar o desenvolvimento do instituto em âmbito europeu e possível aplicação nestas outras duas regiões, com ênfase nas recentes repercussões no caso brasileiro, além de identificar as problemáticas e discussões regionais sobre o tema. O estudo demonstrou que o contexto europeu e o estadunidense possuem posicionamento distintos sobre o assunto, já o contexto latino-americano apresenta-se com problemáticas não somente jurídicas, mas sociais de uma importação do modelo europeu sob uma conjuntura de viabilização de informações pretéritas, embora seja um assunto recente e polêmico. Vislumbra-se, portanto, a aplicação do instituto mediante as características respectivas e inerentes às regiões supracitadas.
