Vulnerability is a recent concept in contract law. in spite of this, the concept has been widely deployed by legal scholars and a significant part of the contract law has been legally analyzed through the idea of vulnerability. This widespread use of the concept raises the question of whether contract law contains a “vulnerability principle”, which should govern cases in which there is a material discrepancy between the parties. this essay addresses this question and answers it negatively
