Abstract

Trata-se neste estudo do esquema criminoso conhecido como “Phishing”. Na primeira parte da exposição é realizada uma análise técnica do Phishing, através da qual são traçadas as suas variantes operacionais e se identificam as vítimas prováveis deste tipo de ataque; na segunda parte, decompõe-se juridicamente a prática de Phishing, indicando o catálogo de ilícitos criminais subjacentes aos momentos fácticos neste contidos, bem como a responsabilidade de agentes e intervenientes, à luz do direito português. Após referência à jurisprudência nesta matéria, são tecidas breves conclusões quanto à aplicação do princípio da legalidade penal a um tipo de atuação criminosa que se serve da crescente complexidade de meios e de acessos informáticos

This study deals with the criminal scheme known as “Phishing”. In the first part of the study a technical analysis of Phishing serves to identify the operational variants of this scheme and the probable victims of this type of attack; in the second part, the scheme is legally decomposed, wi± the indication of the catalog of criminal offenses underlying it’s factual moments under the Portuguese law and the responsibility of agents and actors. After a brief overview of the case law in this area, our conclusions approach the application of the principle of criminal legality to a criminal activity that takes advantage of the growing complexity and access means of information technology
