Abstract

Esta tese destaca a interação entre o constitucionalismo e a regulação sobre o trabalho, evidenciando como o contexto de crise mostra e renova os mecanismos jurídico-político dessa relação. A tese percorre as interrogações da historia do pensamento ocidental sobre o trabalho, com o objetivo de relacionar os desafios do conceito de Constituição do Trabalho com as transformações no campo filosófico, econômico, técnico e organizacional que caracterizam o que se tem qualificado como crise do trabalho. A pesquisa foi inspirada nos debates acerca da crise do estado social durante o período de crise econômica evidenciada a partir de 2007, com investigação em Portugal, na Itália e no Brasil e buscando compreender as relações e distinções com a realidade brasileira. Para a obtenção dos dados, optou-se pelo uso de estudos bibliográficos e jurisprudenciais, com utilização de método multidisciplinar, buscando relacionar o pensamento jurídico com dialogo com os debates sobre o mundo do trabalho realizado em outras ciências como a Historia, Economia, Sociologia e a Filosofia. Estruturado desde um pretenso constitucionalismo pré-moderno do trabalho, a pesquisa atenta-se ao modo como o trabalho foi tratado no constitucionalismo liberal, social, intervencionista, na construção teórica do Estado de bem-estar social, comunitário, em especial, nos debates sobre a crise desses modelos, com uma atenção especial ao modo como o constitucionalismo brasileiro enfrentou essas questões. Revitalizando o conceito de Constituição do Trabalho, a pesquisa realça os problemas da constitucionalização de uma representação jurídica do trabalho, propondo um conceito plurívoco sobre trabalho para este debate. No cenário de transformação do trabalho com a globalização, a tese parte do pressuposto conceitual de um Direito do Trabalho da crise através das formas de erosão de proteções trabalhistas refletidas nas legislações criadas durante uma crise económica para provocar a forca do conceito de Constituição do Trabalho. O resultado confirma a relação entre a regulação do trabalho (protagonizada pelo Direito do Trabalho) e os desafios da construção dogmática jurídico-política de um Estado social baseado na proteção ao trabalho e colocada em choque com um contexto de crise. Toda a tese dialoga com as particularidades luso-brasileiras dos problemas investigados.

This thesis highlights the interaction between constitutionalism and labor regulation, specially how the current crisis context shows and renews its legalpolitical mechanisms. It is a journey through the questions of the history of Western thought about work, with the objective of relating the challenges of the concept of the “Labor’s Constitution” with the transformations in the philosophical, economic, technical and organizational fields, which characterize what is has qualified as a labor crisis. The research was inspired by the debates about the crisis of the Social State during the period of economic crisis, evidenced from 2007, encompassing research in Portugal and Italy, seeking to understand their similarities and distinctions vis-a-vis the Brazilian reality. To obtain the data, we chose to use bibliographical and jurisprudential studies, through a multidisciplinary method, seeking to relate legal thinking to debates on the world of work in other sciences, such as History, Economics, Sociology and Philosophy. Structured from a premodern constitutionalism view of work, this research looks at how it was treated in liberal, social, interventionist constitutionalism, in the theoretical construction of the Welfare State, Community Law, giving emphasis on the discussions of the crisis of such models, with particular attention to the way Brazilian constitutionalism confronted them. Revitalizing the concept of Labor’s Constitution, this research highlights the problems of the constitutionalization of a legal representation of the work, proposing its multifocused concept for the debate. In the scenario of transformation of work due to globalization, the thesis starts from the conceptual assumption of a Labor Law of the Crisis, through the erosion of labor protections reflected in the legislation created during an economic crisis, to challenge the strength of the concept of Labor’s Constitution. The result confirms the relationship between labor regulation (characterized by Labor Law) and the challenges of the legal-political dogmatic construction of a Social State based on the protection of work and placed in shock with a crisis context. The whole thesis is in dialogue with the Portuguese-Brazilian peculiarities of the investigated problems.
