Abstract

O pensamento político moderno confere uma importância central à categoria “direitos”. Esta ênfase veio substituir a centralidade outrora atribuída a ideias como as de utilidade geral ou de integridade do corpo político e tem a marca distintiva da teoria política liberal, cujos autores tendem a subscrever a visão Lockeana de uma ordem política direitos ao serviço da proteção dos direitos pré-políticos dos seus cidadãos. De igual modo, a teoria constitucional encontra nos direitos elementos definidores da ordem social e política. O Estado encontra-se, assim, largamente definido pela natureza, âmbito e alcance dos direitos que protege e implementa através da sua ordem constitucional. Entre estes direitos, encontram-se os direitos sociais que constituem o objecto desta entrada e que vieram complementar os tradicionais direitos “liberais”, civis e políticos. O nosso argumento desenvolve-se em quatro passos. Primeiro, expomos as principais teorias de direitos. Segundo, descrevemos as formas que os direitos podem assumir. Terceiro, discutimos os tipos de direitos, incluindo os direitos sociais. Quarto, analisamos a história dos direitos sociais em Portugal.
