Abstract

Com o desenvolvimento das cidades, fez-se necessária a criação de politicas publicas que ordenassem os espaços para a vida da comunidade, surgindo, assim, regras de ordenamento do território e do urbanismo. Com o surgimento do Estado Social, o 4mbito do urbanismo com funções publicas ganhou um significativo incremento a partir do entendimento da fungo social da propriedade, que limitou o poder absoluto do proprietário sobre seu bem imóvel. O direito de construir é alvo de muitos debates, sendo objeto de diversos litígios judiciais, uma vez que existe a confusão em definir se este direito é uma faculdade intrínseca ao direito de propriedade ou se este direito de construir é apenas uma permissão concedida pela administração publica

With the development of cities, it became necessary to create public policies that would ordain the spaces for the life of the community, thus resulting in rules of land use and urban planning. With the emergence of the Social State, the scope of urbanism with public functions gained a significant increase from the understanding of the social function of property, which limited the owner’s absolute power over his property. The right to build is the subject of many debates and is the subject of various legal disputes, since there is confusion in defining whether this right is an intrinsic right of ownership or whether this right to build is only a permit granted by the public administration
