Abstract

A presente dissertação pretende estudar a figura dos danos não patrimoniais reflexos e a possibilidade do seu ressarcimento. Em nossa opinião, a ressarcibilidade dos danos não patrimoniais reflexos, à semelhança da ressarcibilidade de quaisquer outros danos não patrimoniais, encontra o seu fundamento no n.º 1 do Art.º 496º do CC. Logo, não depende de outra coisa senão da gravidade do dano e das regras gerais da responsabilidade civil. A fórmula adotada pelo ordenamento nacional, relativamente à ressarcibilidade dos danos não patrimoniais, afigura-se suficientemente abrangente de modo a incluir quaisquer danos não patrimoniais, ainda que suportados a título reflexo. Por nós, entendemos que estamos perante a violação de bens de personalidade dos lesados a título reflexo. Por essa razão, a sua ressarcibilidade resultará da conjugação dos Art.os 496.º, n.º 1 e 70º, n.º 1 do CC. Se se aceitar a solução preconizada, deve reconhecer-se que do Art.º 496º, n.º 1 do CC não apenas se retirarão os danos ressarcíveis, mas também os sujeitos que, em abstrato, podem ser titulares da indemnização. Se, nos termos do n.º 1 do Art.º 496º do CC, serão de indemnizar os danos cuja gravidade exija a tutela do direito, as pessoas que suportem danos com tal gravidade terão uma válida pretensão. Fica, portanto, evidente que outras pessoas, além daquelas a quem faz referência o elenco do Art.º 496º do CC, possam ser titulares de um direito de indemnização.

The following dissertation addresses the issue of indirect moral damages and the possibility of its compensation. We conclude that the compensation for indirect moral damages, as any other type of moral damages, is grounded on the article 496º, 1 of the Portuguese Civil Code. Therefore, it does not rely on any other circumstances than the severity of the damage itself and the general rules for civil liability. The solution provided by the Portuguese legal system, regarding the compensation for moral damages, is quite adequate to cover any moral damages even if suffered indirectly. In our opinion, we are facing the violation of personality rights. For that reason, its compensation will result from the combination between the article 496º, 1 and the article 70º, 1 of the Portuguese Civil Code. In case we follow the advocated thesis, we should recognize that from the article 496º, 1 of the Portuguese Civil Code we can not only find the recoverable damages but also the holders of the right to compensation. If, in accordance to article 496º, 1 of the Portuguese Civil Code, we are to compensate the damages which its severity demands the protection of the legal system, therefore any person who have had suffered such damages have a right to compensation. As a result, it is clear that also other individuals beyond the ones included on the article’s cast may have the right to compensation.
