Abstract

Regulamento Geral de Proteção de Dados veio preencher um espaço de regulação nesta matéria anteriormente a cargo da Diretiva 95/46/CE do Parlamento Europeu e do Conselho de 24 de outubro de 1995 e do conjunto das legislações nacionais que operaram a sua transposição para as respetivas ordens jurídicas. Embora esta transição legislativa tenha trazido significativas alterações na disciplina da responsabilidade civil decorrente do tratamento indevido de dados pessoais, no que concerne à redação da norma atinente à possibilidade de exoneração da responsabilidade pelo responsável pelo tratamento, a mesma permanece praticamente inalterada. Não obstante, tal disposição não mereceu ainda um estudo profundo por parte da doutrina, nem tão pouco labor jurisprudencial. Tal não significa que o artigo 82.º, n.º 3 do atual Regulamento não encerre interessantes questões e que a solução das mesmas se quede pacífica entre os vários autores e intérpretes, nomeadamente no que respeita à possibilidade de a mesma prever institutos jurídicos como a presunção ou a eventualidade de a mesma se poder classificar como uma cláusula de exclusão da ilicitude. O presente estudo pretende, desta forma, proceder a uma análise do preceito em questão não apenas do ponto de vista substantivo, mas também refletindo sobre as consequências adjetivas que advêm das posições entretanto adotadas, empreendendo uma viagem hermenêutica pelos vários elementos da interpretação, que leva o leitor a recuar tanto no tempo, até aos primórdios da disciplina de proteção de dados pessoais, como a deslocar-se no espaço, estudando as mutações sofridas nesta matéria em virtude das diferenças de sistema de responsabilidade civil nos vários países.

The General Data Protection Regulation has filled a regulatory area in this area previously under regulation of the Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 and all the national legislations which have transposed it into their legal systems. Although this legislative transition has brought significant changes in the discipline of civil liability resulting from the improper processing of personal data, with regard to the wording of the rule regarding the possibility of disclaiming liability for the controller, it remains virtually unchanged. Nevertheless, this provision has not yet merited a thorough study by the doctrine, nor any jurisprudential labor. This does not mean that Article 82(3) of the current Regulation does not close interesting issues and that their solution is peaceful between the various authors and interpreters, in particular as regards the possibility of providing for legal institutes such as the presumption or the possibility that it may be classified as an illegality exclusion clause. The present study thus intends to carry out an analysis of the precept in question not only from the substantive point of view, but also reflecting on the adjective consequences that come from the positions adopted in the meantime, undertaking a hermeneutic journey through the various elements of interpretation, which leads the reader to go back both in time, to the beginnings of the discipline of protection of personal data, as to move in space, studying the changes suffered in this matter due to the differences in the system of civil liability in the various countries.
