Abstract

O presente trabalho tem como objetivo analisar a possibilidade de criação de uma Corte Constitucional Internacional. A aproximação entre o direito constitucional e o direito internacional possibilitou a formação de uma normatividade constitucional internacional, constituindo-se a base jurídica de atuação deste Tribunal. Ademais, diante de atentados à democracia que continuam a ocorrer ao redor do mundo e a partir da defesa do princípio democrático como uma norma de Ius cogens, defende-se a legitimidade da Corte Constitucional Internacional, bem como a sua necessidade na atual ordem jurídica internacional, com a apresentação do seu Projeto de Criação.

This work aims to analyze the possibility of creating an International Constitutional Court. The approximation between the constitutional law and the international law has made possible the formation of an international constitutional normativity, constituting the legal basis for the action of this Tribunal. Furthermore, in face of attacks to democracy that continue to occur around the world and from the defense of the democratic principle as a norm of Ius cogens, it is defend the legitimacy of the International Constitutional Court as well as its necessity in the current international juridical order, with the presentation of its Creation Project.
