As invalidades formais dos regulamentos administrativos

Abstract

The present dissertation deals with the issue of the invalidity of administrative regulations, more specifically the formal invalidities of administrative regulations and the norm of article 144, paragraph 2, of the current Administrative Procedure Code, as to the depreciation associated with those vices. The regulation is, in the modern administration of a Social State, a tool of administrative activity almost as used as the mythical figure of the general theory of administrative law, the administrative act. Given the proliferation of these norms, it is no less important how the figure should be given, first and foremost, to the vices that affect them, to the possible injuries and violations that they may impose on the private / administered sphere and, therefore, what the right to sanction violations of the Administration in the issuance of an unlawful regulation, materially and formally. The new Code of Administrative Procedure has thus established a substantive regime for administrative regulations and has also created a system for their invalidity. However, there seem to be doubts in the scope of formal invalidity and the associated devaluation that remain to clarify with regard to what is the regime of the invalidity of the administrative act and the desired unity of the legal-administrative system.

A presente dissertação versa sobre a matéria das invalidades dos regulamentos administrativos, mais focalmente nas invalidades formais dos regulamentos administrativos e a norma do n.º 2 do artigo 144.º do actual Código do Procedimento Administrativo, quanto ao desvalor associado àqueles vícios. O regulamento é, na administração moderna de um Estado Social, uma ferramenta da actividade administrativa quase tão utilizada como a figura mítica da teoria geral do direito administrativo, o acto administrativo. Dada a proliferação destes normativos, não é de menos a importância que se deve dar à figura, desde logo aos vícios que os afectam, às possíveis lesões e violações que podem impor na esfera dos particulares/administrados e, por conseguinte, qual a resposta do próprio direito para sancionar a violações da Administração na emissão de um regulamento ilegal, materialmente e formalmente. O novo Código do Procedimento Administrativo veio, assim, consagrar ex-novo um regime substantivo dos regulamentos administrativos, criando igualmente um regime para a invalidade destes. Todavia, parece haver dúvidas no âmbito da invalidade formal e o desvalor associado que ficam por esclarecer face àquilo que é o regime da invalidade do acto administrativo e a unidade que se pretende do sistema jurídico-administrativo.
