Abstract

A presente dissertação realiza-se no âmbito do Mestrado em Direito e Ciência Jurídica, Perfil de Ciências Jurídico-Criminais, a apresentar à Faculdade de Direito da Universidade de Lisboa. O seu objecto incide sobre a figura da «imputabilidade diminuída», outrora presente na legislação portuguesa e eliminada no Código Penal de 1982, sendo substituída pelo regime que hoje consta do artigo 20.º, números 2 e 3, do mesmo Código. Esta norma invoca as mais profundas controvérsias sobre a culpa, o fundamento da responsabilidade penal, o comportamento humano, a distinção entre o indivíduo «normal» e o «anómalo» e, por fim, da questão última de punir ou não punir.

This dissertation was writen in the context of the Masters in Law and Juridical Science, Juridical-Criminal Profile, to be submited to the University of Lisbon School of Law. Its object is the legal institution of «diminished imputability», once present in Portuguese law and deleted in the 1982 Criminal Code, being replaced by the regime of the current article 20, numbers 2 and 3, of said Code. This norm invokes serious controversies on guilt, foundation of criminal responsibility, human behaviour, distinction between «normal» and «anomalous» individual and, finally, the matter of wether or not to punish.
