A presente dissertação de mestrado consiste num estudo do mecanismo da redução por inoficiosidade, no âmbito do sistema sucessório português, procurando perceber de que forma se processa a tutela conferida à posição do herdeiro legitimário, à luz do Direito constituído. O estudo realizado incidirá essencialmente na sucessão legitimária comum, sendo a redução por inoficiosidade um mecanismo de defesa da intangibilidade quantitativa da legítima. Para efeitos do presente trabalho, importa, desde logo, analisar as regras da imputação e, dentro do mecanismo da redução por inoficiosidade, as divergências relativas à sua natureza jurídica, a sua forma de operar, as suas implicações, onde é possível verificar, por exemplo, uma contraposição entre o estatuto do herdeiro legitimário e do donatário e, neste sentido, perceber a dimensão da protecção que é conferida, ainda nos dias de hoje, ao herdeiro legitimário. Neste contexto, propõe-se uma reflexão sobre as matérias centrais da modalidade de sucessão legitimária, como é o mecanismo de redução das liberalidades inoficiosas, da qual fará parte o estudo dos seus aspectos considerados mais criticáveis pela doutrina, a sua relação com outros direitos, como é o caso da usucapião e da hipoteca. Por fim, será ainda analisado de que forma o instituto pode ou não pôr em causa a vontade do de cujus ao se privilegiar a sucessão legitimária e a tutela que é conferida ao herdeiro legitimário, em detrimento da liberdade de disposição patrimonial do autor da sucessão e consequentemente da sucessão voluntária, apresentando-se o que se julga que poderia ser uma das vias para a renovação do Direito sucessório português.

This master thesis consists on a study of a mechanism named reduction by inofficiousness, under the Portuguese succession Law. With this thesis we seek to understand how the protection granted to the position of the mandatory heir is processed under the established legislation. This study will focus the common mandatory succession, also focusing on the legal action of reduction by inofficiousness which it is used to protect the heir’s legitim in its quantitative intangibility. For the purposes of this paper, it is therefore important to analyse the rules of the imputation method and also the differing doctrinal opinion in what concerns the reduction by inofficiousness’ mechanism, its legal nature, its way of operating and all its legal implications, namely the opposition between the mandatory heir’s legal status and the donee’s legal status. In this sense, we seek to perceive the dimension of the legal protection that still is given to the mandatory heir nowadays. In this context, we proposed a reflection on the mandatory succession’s main subjects, its most criticised aspects, its legal relation with other legal rights such as usucaption and legal mortgage and also in what way the reduction by inofficiousness can jeopardize the deceased’s last will by favoring the mandatory succession and the protection given to the mandatory heir to the detriment of the deceased’s freedom of disposition of assets and consequently the voluntary succession, in order to present what could be one path for the renovation of Portuguese Succession Law.
