Abstract

The subjective bond is a determining factor in the imputation of a fact as joint perpetration. This seemingly simple statement has several implications. First of all, one must pay attention to the idea of imputation as joint perpetration, which demonstrates the constitutive character of this participatory figure and its consequent inclusion in the imputation judgment. This stems from the restrictive-singular concept of perpetrator, by which every prediction of a participatory figure is a typical extension that will ground the imputation. The elements of joint perpetration, then, become part of the judgment of attribution of responsibility (a part of the offence, one might say), as the founding criteria of this. Hence, there is no such a thing as an abstract imputation of someone as an author. It will always refer to a specific kind of autorship which attributes to the differentiating criterion of perpetration and accomplice (controlo f the offence) only general character, leaving the concretion of the parameters to each kind of authorship. Besides that, it should be noted that the mental connection, object of this study, is a subjective element, but its determining influence in the attribution of responsibility goes beyond the limits of indicating the intent for the fact, having direct interference in the meaning of the action, in the objective offence. The present study aims to understand the imputation dynamics of joint perpetration, especially regarding the analysis of the psychological connection. Criminal participation is based on cooperation between people for the commission of a crime. It demands, therefore, simultaneous attention to the global and personal dimensions of the fact, which implies the recognition of a imputation logic called here two-dimensional imputation. Collaboration is understood from the offences extension scenarios provided in the General Part of Criminal Codes, and its characteristics became part of the decision. Participation hypothesis such as the criminal type itself and even human conduct, are an objective-subjective whole and all its elements are part of the imputation. In the focus of this work, the subjective bond that is part of the co-authorship is analyzed in its essential characteristics, and from this examination several imputative implications arise. The moment in which it takes place, the content that it covers, its form, the (un)necessity of equivalent presence in all participants… Several scenarios bring diverse imputative consequences that go beyond the scope commonly reserved for the subjective type in the dogmatic analysis of crime. Thus, hrough the understanding of the co-authorship institute and its subjective link one can indicate the mutual interference of objective and subjective elements and establish an appropriate imputation rationality that simultaneously analyzes the global and personal dimensions of the fact under objective and subjective perspective, inseparable and interdependent criteria.

O vínculo subjetivo é elemento determinante da imputação de um fato como coautoria. Esta afirmação, aparentemente singela, traz consigo diversas implicações. Primeiramente há que se atentar para a ideia de imputação à título de coautoria, que indica o caráter constitutivo desta figura comparticipativa e sua consequente inclusão no juízo de imputação. Isto decorre do conceito restritivo-singular de autor, pelo qual toda previsão de hipótese comparticipativa é uma extensão típica que embasa a imputação. Os elementos da coautoria, então, passam a integrar o juízo de atribuição de responsabilidade, como critérios fundamentadores desta. Consequentemente, se prescinde de uma imputação abstrata do sujeito como autor, sendo esta sempre referente a uma forma específica de autoria, o que atribui ao critério diferenciador de autoria e participação (domínio do fato) apenas caráter reitor, deixando a concretização dos parâmetros a cada espécie de autoria. Além disso, note-se que o vínculo, objeto do presente trabalho, é elemento subjetivo, mas sua influência determinante na atribuição de responsabilidade ultrapassa os limites de indicação de dolo ou culpa pelo fato, havendo interferência direta no significado da atuação, na tipicidade objetiva. O presente estudo visa compreender a dinâmica de imputação da coautoria, em especial no que se refere à análise do vínculo subjetivo. A comparticipação eventual fundamenta-se na cooperação entre pessoas para a prática de um delito uno. Exige, portanto, atenção simultânea às dimensões global e pessoal do fato, o que implica no reconhecimento de uma lógica de imputação chamada aqui de imputação bidimensional. A colaboração é entendida a partir das hipóteses de extensão típica previstas na Parte Geral, cujas características integram o juízo de atribuição de responsabilidade. As figuras comparticipativas, como o próprio tipo penal e mesmo a conduta humana, são um todo objetivo-subjetivo e todos os seus elementos compõem o juízo de imputação. No enfoque deste trabalho, o vínculo subjetivo integrante da coautoria é analisado em suas características essenciais, e deste exame decorrem diversas implicações imputativas. O momento em que se perfaz, o conteúdo que abarca, sua forma, a (des)necessidade de presença equivalente em todos os comparticipantes... Diversos cenários trazem consequências imputativas que ultrapassam o âmbito comumente reservado para o tipo subjetivo na análise dogmática do delito. Assim, pela compreensão do instituto da coautoria e de seu vínculo subjetivo, pode-se indicar ainterferência mútua de elementos objetivos e subjetivos e estabelecer uma racionalidade apropriada de imputação que analise simultaneamente as dimensões global e pessoal do fato sob perspectiva objetiva e subjetiva, uma vez que os critérios são indissociáveis e interdependentes.
