Lacunas em direito administrativo

Abstract

A presente dissertação teve como objetivo investigar o fenômeno das lacunas em Direito Administrativo de forma ampla. Assim, sua pretensão foi verificar como as lacunas interagem com a juridicidade administrativa, sua ocorrência em campos em que a legalidade administrativa desempenha um papel especial, os métodos de sua solução e como deve atuar a Administração diante de uma lacuna. A investigação foi dividida em duas partes: a primeira tratou da existência de lacunas na juridicidade administrativa e a segunda, a solução administrativa de lacunas. A partir de um conceito que identifica as lacunas como um fenômeno natural de mutabilidade normativa, inerente à abertura dos enunciados normativos, na primeira parte da dissertação se verificou que a juridicidade administrativa é ainda concebida sob diversos aspectos como fechada, concepção que nega a existência de lacunas em variados campos da juridicidade administrativa, em contraposição com o conceito normativo e de lacunas adotado. Na segunda parte, a investigação se volta para a solução de lacunas, reconhecendo apenas a analogia e os princípios jurídicos fundamentais como métodos que possibilitam a solução de lacunas e que não se submetem a vedações abstratas à sua utilização, mas que devem respeitar as condições democráticas, a racionalidade jurídica e a intencionalidade normativa. Ainda, a investigação verifica os deveres e consequências da atuação administrativa diante de uma lacuna, reconhecendo um dever geral de solução de lacunas diante de casos concretos. Entretanto, não verifica um dever de alterar uma fonte administrativa quando esta contenha uma lacuna, bem como relega a equivocada solução de lacunas à categoria das invalidades em geral.

This dissertation aimed at investigating the phenomenon of gaps in Administrative Law in a broad way. Thus, its intention was to verify how the gaps interact with administrative legality, its occurrence in fields in which administrative legality plays a special role, the methods of its solution and how the Administration must act before a gap. The investigation was divided in two parts: the first dealt with the existence of gaps in administrative legality and the second the administrative solution of gaps. Based on a concept that identifies gaps as a natural phenomenon of normative mutability, inherent to the opening of normative statements, in the first part of the dissertation it was verified that administrative legality is still conceived under several aspects as closed, conception that denies the existence of gaps in various fields of administrative legality, as opposed to the normative and gaps concept adopted. In the second part, the investigation focuses on the solution of gaps, recognizing only analogy and fundamental legal principles as methods that allow the solution of gaps and that are not subject to abstract fences to their use, but that must respect the democratic conditions, legal rationality and normative intentionality. Furthermore, the investigation verifies the duties and consequences of administrative action in the face of a gap, recognizing a general duty to solve gaps in concrete cases. However, it does not verify a duty to change an administrative source when it contains a gap, as well as relegates the misleading solution of gaps to the category of invalidity in general.
