A análise das normas de direitos fundamentais tem despertado profundo interesse da comunidade jurídica nas últimas décadas. Um dos problemas mais sensíveis nesta área tem sido a real compreensão da natureza e aplicação das normas de direitos sociais, em especial pela crescente busca de concretização destas normas pela via judicial. Assim, conhecer mais profundamente o caráter e a força normativa destas normas é fundamental para compreender sua respectiva efetivação. Ademais, em razão da crescente expectativa da sociedade na busca pela oferta de direitos sociais pelo Estado, é necessário firmar um entendimento acerca da legitimidade da tutela judicial na concretização destas normas, buscando-se objetivar uma metodologia capaz de proporcionar parâmetros para a atuação judicial. O trabalho, portanto, na sua primeira parte, busca oferecer uma compreensão geral sobre a origem, positivação e natureza dos direitos sociais, em especial sua relação com os princípios da dignidade da pessoa humana e da igualdade. Para além disto, é necessário que o estudo da concretização destas normas leve em consideração as questões financeiras afetas ao orçamento estatal. Na segunda parte, o trabalho é desenvolvido com o propósito de analisar a atuação da tutela judicial na efetivação dos direitos sociais. Para esta abordagem, além das questões de controle de constitucionalidade no Estado de Direito Democrático, parte-se para uma análise dos conflitos normativos, identificando-se a ponderação como método de abordagem das colisões. Ao final, identifica-se o princípio da proporcionalidade como a via capaz de firmar parâmetros para o exercício da tutela judicial, atividade esta que é desenvolvida com o auxílio dos princípios da dignidade da pessoa humana, da igualdade e da proteção confiança.

The analysis of fundamental rights has stimulated deep interest within the legal community in recent decades. One of the most important problems in this area has been the real understanding of the nature and application of social rights norms, in particular through the increasing demand for the enforcement of these norms by judicial means. Thus, knowing more deeply the character and normative force of these norms is fundamental to understand their respective effectiveness. Furthermore, due to the growing expectation of society in the search for the offer of social rights by the State, it is necessary to establish an understanding of the legitimacy of judicial protection in the implementation of these norms, seeking to identify a methodology capable of providing standards for judicial action. This study, therefore, in its first part, seeks to offer a wide understanding about the history, affirmation and nature of social rights, in particular its relation with the principles of human dignity and equality. In addition, it is necessary that the study of the implementation of these rules takes into account the financial issues related to the state budget. In the second part, the study is developed with the purpose of analyzing judicial protection in the establishment of social rights. For this approach, besides the issues of constitutionality control in the State of Democratic Right, there is a need for the analysis of normative conflicts, identifying weighting as method to tackle collisions. Finally, the principle of proportionality is identified as a means capable of establishing parameters for the exercise of judicial protection, an activity that is developed with the aid of the principles of human dignity, equality and protection of trust.
