Abstract

A busca da essência justificadora das Imunidades Parlamentares foi o propósito do presente trabalho. Para tanto, buscou-se, por meio do enfrentamento de temas sensíveis ao instituto, buscar suas origens, suas fundamentações, seus princípios e seus objetivos, os quais, quando da criação, deram alma ao instituto. No decorrer do trabalho, após o enfrentamento, tanto no âmbito interno de cada país examinado, quanto na esfera internacional, das imunidades, foram enfrentadas as variações temporais e de conteúdo do instituto, com análise crítica a respeito das causas e consequências dessas variações, quer no âmbito político, quer na teoria própria dos elementos do tipo penal. Ao final, como consequência lógica de todo esse enfrentamento, trouxe-se uma releitura das imunidades parlamentares, dando conta, não só da alteração de sua essência legitimadora, como, da necessidade de manutenção desta, com tais alterações, a fim de justificar a existência do instituto, buscando, como tal, a atividade legislativa como norte.

The search for the essence justifying Parliamentary Immunities was the purpose of this work. Therefore, it sought through the coping sensitive issues to the institute, to seek its origins, its foundations, its principles and objectives, which, when setting gave soul to the institute. During the work, after the confrontation, both within each country examined, as in the international sphere, the immunities, the timing and content of the institute variations, with critical analysis about the causes and consequences of these changes were faced either in the political realm or in the very theory of the criminal type elements. Finally, as a logical consequence of all this confrontation brought to a reinterpretation of parliamentary immunities, taking account not only the change of its legitimating essence, as the requirement for this, with such changes in order to justify the existence the institute, seeking, as such, the legislative activity as north.
