Abstract

A presente revisão aborda o dilema da revelação da seropositividade, para o VIH, ao parceiro sexual, em especial quando existe relutância deste em fazê-lo e, quando desta, surjam perigos para a saúde dos outros, bem como identificar quais os limites da nossa possível revelação. Pretende-se, igualmente, explorar de que forma esta situação problema pode constituir um conflito de interesses e deveres para o médico. A solução não tem sido unânime e diversos profissionais assumem diferentes posições. A revisão procura desenvolver uma reflexão sobre os direitos e deveres das pessoas envolvidas na situação- pacientes e profissionais de saúde, partindo do conhecimento legal e ético para análise do ponto de vista da Bioética. Aborda as possibilidades permitidas pela legislação para a quebra do sigilo profissional e sua conveniência para a prevenção, e sugere algumas directrizes para enfrentar tal problema sem perder de vista os princípios universais que orientam a biomedicina. Para tal foi consultada a legislação pertinente ao assunto, os códigos de ética médica e vários artigos que preenchessem os objectivos da revisão na tentativa de descobrir condutas mais adequadas.

This review addresses the dilemma of disclosure of HIV status to the sexual partner, especially when there is reluctance to do it, and when this, arise dangers to the health of others, and identify the limits of our possible revelation. It is intended to also explore how this problem situation may constitute a conflict of interest and duties to the doctor. The solution has not been unanimous and many professionals assume different positions. The review seeks to develop a reflection on the rights and duties of those involved in situation- patients and health professionals, based on the legal and ethical knowledge to analysis of the bioethics standpoint. Discusses the possibilities allowed by law for breach of professional secrecy and its suitability for the prevention, and suggests some guidelines to tackle this problem without losing sight of the universal principles that guide biomedicine. This is why we consulted the relevant legislation to the subject, medical ethics codes and several articles that met the objectives of the review in an attempt to discover more appropriate behaviors.
