A protecção de testemunhas no crime organizado

Abstract

The organized crime study is a growing concern in Europe and in the rest of the world. However, there is not much information on this topic. It is a complex subject that has undergone some significant changes, since our society is undeniably crimogenic and is constantly evolving. The technological resources have increased and this problem’s complexity has become an arduous task by wanting to ensure and guarantee the legal asset of security. At the same time, it’s not possible to neglect other fundamental rights, freedoms and guarantees. In this respect, our legal framework, demand that the witness is the eyes of justice. Even if she's not a party, it enables that she participates in seeking the truth. However, it worries so much in establishing the truth and handle the evidence, which is the witness's testimony, that forgets some of the essential protection of her legal interests, as well as the principles of criminal proceedings, which are inherent to all integral parts of the process. These unbalanced practices can often lead to a less fair procedure.

O estudo do crime organizado é uma preocupação crescente na Europa e no mundo. No entanto, não existe muita informação acerca deste tema. É um tema complexo que tem sido alvo de mudanças significativas, uma vez que a sociedade é inegavelmente criminógena e está numa constante evolução. Os meios tecnológicos aumentaram e a complexidade deste problema tornou-se uma tarefa árdua ao querer garantir e assegurar o bem jurídico segurança, ao mesmo tempo tem de se ter especial atenção, aos demais direitos, liberdades e garantias. Neste sentido nosso quadro legal, procura que a testemunha seja os olhos da justiça, ainda que não seja sujeito processual, possibilita que esta participe no apuramento da verdade. Contudo, preocupa-se demasiado em apurar a verdade e em manusear o meio de prova, que é o depoimento da testemunha, que acaba por descurar da sua protecção jurídica, bem como, dos princípios do processo penal que estão inerentes a todas as partes integrantes do processo. Estas práticas pouco equilibradas podem muitas vezes levar a um processo menos justo.
