A fundamentalidade do direito de acesso à água potável

Abstract

O tema da tese é a fundamentalidade do direito de acesso à água potável e o dever de fornecimento de água nos serviços públicos de abastecimento. O objetivo traçado foi o de analisar à luz da teoria dos direitos fundamentais os fundamentos que justificam o reconhecimento desse direito no ordenamento jurídico brasileiro como fundamental, passível de gerar o dever de fornecimento de água nos serviços públicos de abastecimento. Para atender a esse objetivo, o trabalho é apresentado em seis capítulos. No primeiro, verifica-se o conceito de água potável, classificações e a sua importância. No segundo, analisa-se o direito de acesso à água potável. No terceiro, analisam-se o conceito e os fundamentos da caracterização de um direito como fundamental. No quarto, são verificadas as múltiplas formas de reconhecimento da fundamentalidade do direito de acesso à água potável. No quinto, verifica-se a configuração jurídica e a multifuncionalidade do direito fundamental de acesso à água potável. No último capítulo, analisa-se o direito-dever de acesso à água nos serviços públicos de abastecimento. A metodologia utilizada para atingir a finalidade dessa investigação foi variada. De certa forma rompendo com a tradição, utiliza-se do enfoque analítico como forma preponderante de abordagem metodológica. Conclui-se que, no ordenamento jurídico brasileiro, o direito de acesso à água potável é reconhecido como um direito fundamental a partir da cláusula de abertura constitucional. Os fundamentos para essa caracterização são de que esse direito está relacionado com o resguardo e com a promoção da dignidade humana. Por fim, conclui-se que a efetividade do direito-dever fundamental de acesso à água, notadamente, nos serviços públicos de abastecimento, não corresponde aos anseios da sociedade. Por isso, é necessário que seja concretamente reconhecida a fundamentalidade do direito de acesso à água potável e o dever fundamental de fornecimento de água nos serviços públicos de abastecimento.

The theme of the thesis is the fundamentality of the right of access to drinking water and the duty to provide water in the public services of supply. The objective set out was to analyze, beneath the perspective of the theory of fundamental rights, the grounds which justify the recognition of this right in Brazilian law as fundamental, likely to create the duty to provide water in the public services of supply. To achieve this goal, the thesis is presented in six chapters. In the first chapter, it is analyzed the concept of drinking water, its classifications and its importance. In the second, it is analyzed the right of access to drinking water. In the third, it is analyzed the concept and the fundaments of the characterization of a right as a fundamental right. In the fourth, it is verified the multiple forms of recognition of the fundamentality of the right of access to drinking water. In the fifth, it is verified the legal configuration and the multifunctionality of the fundamental right of access to drinking water. In the last chapter, it is analyzed the right and duty of access to water in the public supply services. The methodology used to achieve the purpose of this investigation was varied. Somehow breaking with tradition, it is used the analytical approach as prevailing form of methodological approach. It is concluded that in the Brazilian legal system, the right of access to drinking water is recognized as a fundamental right, what occurs from the clause of constitutional opening. The reason for this characterization is that this right is related to the safeguarding and promotion of human dignity. Finally, it is concluded that the effectiveness of the right and duty of access to water, especially in public services of supply, does not match the expectations of society. For this reason, the fundamentality of the right of access to drinking water and the duty to provide water in the public services of supply must be concretely recognized.
