Abstract

Esta dissertação toma como objeto a Tutela Judicial dos Direitos Sociais no cenário do Estado de Direito democrático. Para alcançar este propósito, formularam-se os seguintes objetivos: a) analisar a trajetória de reconhecimento dos Direitos Sociais em perspectiva histórica e internacional; b) investigar as relações entre diferentes concepções e fundamentos constitucionais dos Direitos Fundamentais e Sociais no Estado de Direito democrático; c) discutir problemas e perspectivas da jurisdição constitucional pertinentes aos Direitos Sociais, considerando, entre outros aspectos, os limites e possibilidades de exigibilidade dessa espécie de direito, no contexto da separação de poderes no Estado contemporâneo. Do ponto de vista metodológico, desenvolveu-se pesquisa descritiva, cujas fontes principais foram: legislação internacional, doutrina produzida por juristas de diferentes países, que trazem a lume alguns consensos e divergências quanto à justiciabilidade dessa espécie de direito, bem como jurisprudência de alguns tribunais sobre a resolução de conflitos nessa importante área do Direito. Ao final, apresentam-se considerações, críticas e sugestões, no intuito de contribuir para a garantia e coerência no desenvolvimento de uma sociedade cidadã, solidária e inclusiva, que participa da formulação, execução e avaliação de políticas públicas de toda ordem, inclusive no que diz respeito aos Direitos Sociais.

This dissertation takes as object the jurisdicional protection of social rights in scene of the Democratic State of Law. To achieve this purpose, the following objectives has been developed: a) the analysis of the trajectory of Social Rights recognition in international and historic perspectives; b) the research about relationships between different constitutional fundamentals conceptions about social and fundamental rights in the Democratic State of Law; c) to discuss problems and prospects of constitutional jurisdiction about social rights, considering, inter alia, the limits and possibilities of knowledge of this cast of rights, in the context of the separation of powers in the contemporary State. From the methodological point of view, we developed descriptive research, whose main sources were: international law and doctrine produced by thinkers from different countries, who bring lights over the consensus and disagreements about the justiciability of this cast of rights, as well as jurisprudence of some courts about conflicts in this important area of Law. By the end, we present some considerations and suggestions, in order to contribute to the security and consistency in the development of a civic, solidary and inclusive society, which participates in the formulation, implementation and evaluation of public policies of all kinds, including social rights.
