Abstract

O presente estudo tem por a análise da responsabilidade do devedor por facto de outrem. Trata-se de um tema que se insere na responsabilidade obrigacional, incluindo não apenas o incumprimento dos contratos, como também o de qualquer outra obrigação, independentemente da respetiva fonte. É um estudo de Direito civil, cujo ponto central de análise reside no artigo 800.º do Código Civil Português. Neste trabalho, é analisado o recurso por parte do devedor a auxiliares de cumprimento e consequente responsabilidade do devedor, perante o credor, pela atuação daqueles. Esta figura é, por sua vez, delimitada em face de outras situações que lhe são especialmente próximas, mas que com ela se não confundem. Para além disso, é ainda abordada a atuação do representante legal do devedor e suas repercussões em termos de responsabilidade obrigacional. Um aspeto fundamental reside igualmente na delimitação da responsabilidade do devedor em face da responsabilidade extra-obrigacional por facto de outrem, em especial no que diz respeito aos deveres de proteção da contraparte e, bem assim, aos deveres impostos às partes na fase prévia de celebração dos negócios jurídicos. É em especial analisada a responsabilidade do empregador por facto de outrem no âmbito dos acidentes de trabalho. Por fim, é abordada a questão da fundamentação da responsabilidade do devedor por facto de outrem, com base nas diversas teses que a doutrina desenvolve a este respeito.

The present study is the analysis of the debtor’s responsibility for the acts of his auxiliaries. It is a theme that fits in the obligatory liability, including not only the breach of contracts, as well as any other obligation, irrespective of their source. It is a study of civil law, whose central point of analysis is Article 800 of the Portuguese Civil Code. In this paper, we analyze the resource by the debtor to auxiliaries and consequent liability of the debtor to the creditor, for the performance of those. This figure is in turn bounded in the face of other situations especially close to it, but with which it shall not be confused. Furthermore, it is still addressed the role of the legal representative of the debtor and its repercussions in terms of obligatory responsibility. A fundamental aspect also lies in the frontiers of the liability of the debtor in the face of non contractual liability for other’s facts, especially in regard to the duties of protection of the counterparty and, also, the duties imposed on the parties in the previous phase of celebration of contracts. It particularly is also analyzed the liability of the employer for other’s facts within the work accidents. Finally, we discuss whether the grounds for liability of the debtor for other’s facts, based on various theories that doctrine develops in this regard.
