Abstract

A temática da biodiversidade passou, nos últimos anos, de assunto de segunda linha, para prioridade das agendas política e económica mundiais, por estar em causa o modelo de desenvolvimento económico e social que, correlacionado com a expansão urbana, aumento da população mundial e o fenómeno das alterações climáticas, tem conduzido a uma catastrófica destruição da fauna e da flora terrestres. Os Estados, cada vez mais conscientes da gravidade destes fenómenos, procuram reconciliar-se com o seu Planeta, quer limitando a intervenção humana sobre o Ambiente, quer adoptando políticas de desenvolvimento sustentável. É precisamente nesta linha - de preocupações ambientais - que surge, no Direito Internacional do Ambiente, o instituto das Reservas da Biosfera, enquanto um dos instrumentos que se presta à tutela e conservação da biodiversidade. Ao longo, da sua evolução histórica, as RB procuraram adaptar o seu modelo de gestão à evolução do nosso Planeta e aos desafios contemporâneos que têm sido impostos pela actuação do Homem, sendo a questão das alterações climáticas, um dos últimos episódios. Neste domínio, as Reservas da Biosfera assumem, um papel de relevo como modelos de gestão dos recursos naturais e a ideia de sustentabilidade pode encontrar um ponto de apoio no modelo de gestão adoptado: zona núcleo, zona tampão e zona de transição. A juridicidade das RB assentam na denominada soft law, sendo importante, por um lado, a implementação de um modelo de gestão que promova a governança ambiental multilevel e aprofunde o princípio da subsidariedade (atendendo à dimensão transfronteiriça e transnacional dos recursos naturais) e, por outro lado, a satisfação das necessidades de fruição económica por parte das populações, permitindo ao mesmo tempo a preservação e tutela da biodiversidade.

The theme of biodiversity passed in recent years, the subject of the second line, the priority for policy and global economic agendas, being concerned the model of economic and social development, which correlated with urban sprawl, increasing world population and the phenomenon of climate change has led to a catastrophic destruction of terrestrial fauna and flora. States, increasingly aware of the gravity of these phenomena, seek reconciliation with your Planet, or by limiting human intervention on the environment, both in adopting sustainable development policies. It is precisely this line - environmental concerns - which appears in the International Law of the Environment, Institute of Biosphere Reserves as an instrument that lends itself to the protection and conservation of biodiversity.Over the course of its historical development, the RB sought to adapt its management model to the evolution of our planet and the contemporary challenges that have been imposed by the act of man, and the issue of climate change, one of the last episodes. In this area, Biosphere Reserves assume a prominent role as models of natural resource management and the idea of sustainability can find a foothold in the management model adopted: core zone, buffer zone and transition zone. The legality of RB based on the called soft law, it is important, on the one hand, the implementation of a management model that promotes multilevel environmental governance and deepen the principle of subsidiarity (taking into account the cross-border and transnational dimension of natural resources), and Moreover, meeting the needs of economic enjoyment of the populations, while allowing for the preservation and protection of biodiversity.
