Abstract

The present essay discusses the Cross Appeal, stipulated in article 682º of the Code of Civil Procedure, representing an approach to it´s incorporation in the portuguese appeal system. In the first place, we inquire the historical and juridical reasons underlying the existence of the Cross Appeal. Subsequently, not intending to exhaust all of it´s aspects, but to make a brief analysis of the most relevant questions regarding the application of article 682º of the portuguese Code of Civil Procedure and, in the search for a contribution to the study of the Appeals Theory, we seek to know what judicial decisions can the Cross Appeal regard to, the prerequisites for it´s application, to what extent is the Second Appeal dependant from the First Appeal, and the period for it´s lodging, as well as it´s procedure and effects in the global appeal´s object, pointing the opinions that the doctrine and case law have adopted and the disputes regarding this type of appeal. Finally, a reference is made to it´s insertion outside the Code of Civil Procedure, stressing the nuances of it´s existence in other procedural laws.

A presente dissertação versa sobre a figura do Recurso Subordinado prevista no art. 682º do Código de Processo Civil, constituindo uma abordagem às razões da sua consagração e à sua inserção no âmbito do sistema de recursos português. Procede-se, em primeiro lugar, à abordagem das razões históricojurídicas subjacentes à existência do Recurso Subordinado. Subsequentemente, sem pretender esgotar todos os seus aspectos, efectua-se uma breve análise das questões mais relevantes no que respeita à aplicação do art. 682º do C.P.C. e, visando-se uma contribuição para o estudo da Teoria Geral dos Recursos, são analisadas as questões de saber quais as decisões judiciais que podem ser objecto de Recurso Subordinado, os pressupostos da sua interposição e o grau de dependência do mesmo em relação ao Recurso Independente/Principal, bem como o seu procedimento e efeitos no objecto recursal, frisando-se as posições que a doutrina e jurisprudência vêm adoptando e as controvérsias geradas em torno da figura. Por último, é feita referência às diferentes nuances da sua previsão na restante legislação adjectiva portuguesa.
