O presente estudo visa analisar a problemática do envelhecimento, na perspectiva da violência contra os idosos, designadamente no prisma da punição do crime de maus tratos, previsto no artigo 152.º-A do Código Penal. Nesta dissertação é feita uma breve análise sobre o processo de envelhecimento e sobre a forma como este tem sido encarado pela comunidade internacional e nacional, à luz dos direitos fundamentais. São igualmente analisadas as condutas que evidenciam práticas violentas contra as pessoas idosas, aquelas que são suscetíveis de integrar a previsão do crime de maus tratos e respetivas características. De igual forma, são também analisadas as questões processuais penais relativas ao referido crime, tanto na fase de inquérito, como na fase de julgamento. Designadamente, é feita uma análise sobre os meios de prova mais relevantes para a prova do crime e, sobre a suscetibilidade da punição das pessoas coletivas, que exploram estabelecimentos de apoio social a idosos, pela sua prática.
The present study aims to analyze the specific features associated with aging and elder abuse, particularly about the specific crime of mistreatment, described on Portuguese penal code. In this thesis, it is also analyze the aging process and the way aging is look for the international and national communities, considering fundamental rights. We do also analyze the acts that evidence elder abuses and those who join in the crime of mistreatment and respective features. Similarly are also analyzed criminal procedural matters relating to this crime on investigation and trial stages. In particularly an analysis of the most relevant evidence, to prove the crime, is made, as so as, an analyze about the susceptibility of legal persons, owners of nursing homes, being punish by the committed of mistreatment.
