Abstract

O Cooperativismo é fato social de tamanha relevância que expandiu seu complexo sistema por todo o mundo, gerando riquezas e levando à ocorrência de inúmeras situações ecosocioeconômicas, com importantes e inequívocos reflexos jurídicos. A Sociedade Cooperativa é uma pessoa jurídica formada a partir da vontade de um grupo, delimitado por uma dificuldade econômica, que constitui a sociedade unicamente para prestar-lhe serviços diretos, obrigando-se, os membros do grupo, a contribuírem com bens e serviços para exercício de uma atividade de proveito comum. Ao analisar as atividades das Sociedades Cooperativas, suas implicações de cunho obrigacional e contratual, desenvolvidas internamente com seus membros cooperados, tal qual aquelas de reflexos externos, de caráter social e empresarial, operacionalizadas com terceiros, estranhos ao conjunto societário cooperativo; resultam constantes indagações no que tange ao seu enquadramento legal. O presente estudo ao incursionar pelo histórico do Cooperativismo, visando entender sua gênese, possibilita prosseguir pelo caminho seguido pelos sistemas legislativos que levaram à constituição dos Códigos Cooperativos, ou legislações especiais a ele pertinentes, nos diversos cantos do mundo, interessando em especial o sistema Cooperativo em Portugal e no Brasil. Tal forma de observação e confrontação dos regimes jurídicos persegue o acesso à base do sistema legal dos países que tratam do tema Cooperativo, especial destaque a Portugal e Brasil, como forma de atestar a adoção dos princípios cooperativos, comuns a todos, que advém do seu regime histórico, e levam a uma verdadeira Identidade Cooperativa, com Leis ou Códigos Cooperativos muito similares.

Cooperativism is a social fact of great relevance, which has expanded its complex system throughout the entire world, generating riches and leading innumerous ecosocioeconomical situations into occurrence with important and unequivocal judicial reflexes. A Cooperative Society is a corporate entity established by a group, marked by an economical difficulty, having been created in order to contribute direct services to itself, having all members obliged to contribute with assets and services towards the exercise of a common good. When analyzing Cooperative Society's activities, its obligations and contractual implications developed internally by its members, as well as those with external reflexes, both social and entrepreneurial, operated by third parties, constant questions arise concerning its legal framework. This study, while venturing through Cooperative Societies' history, attempting to understand its beginnings, allows us to proceed through the legislative systems' pathway, which has led to the creation of the Cooperative Codes, legislations pertinent to these Cooperative Societies, in different parts of the world, with special interest towards Cooperative systems in Portugal and Brasil. This form of observation and confrontation of judicial regimes concerns the basis of the legal systems in countries that deal with the Cooperative theme, focusing especially in Portugal and Brasil, in order to certify the adoption of cooperative principles, common to all, that is brought by its historical regime, and leads to a true Cooperative Identity with very similar laws and Cooperative Codes.
