Activismo judicial e os seus descontentes

Abstract

A presente investigação visa estudar o problema do activismo judicial, partindo dos ensinamentos da experiência constitucional dos Estados Unidos da América. É, com efeito, na jurisprudência e na doutrina norte-americana que a problemática que ora investigamos tem merecido uma intensa e frutuosa discussão, lançando as coordenadas gerais de compreensão do activismo da jurisdição constitucional à escala global. Pretendemos aferir os fundamentos constitucionais do poder reconhecido aos tribunais de invalidar actos aprovados pelo legislador dotado de legitimidade democrática directa. Por outro lado – e admitindo a admissibilidade constitucional da judicial review -, importará definir os limites de actuação do poder judiciário, evitando usurpações do poder legislativo. Por último, analisaremos se, em caso de conflito entre a jurisdição constitucional e o poder legislativo democraticamente eleito, a Constituição confere prevalência ao legislador, enquanto órgão representativo do povo.

This dissertation aims to understand, under a legal perspective, the constitutional foundations of judicial review of legislation. In order to achieve the mentioned goal, the United States of America constitutional history and system will be analyzed, as well as the most prominent american legal scholars doctrines and Supreme Court landmark cases. Subsequently, the lessons from United States constitutional history will be apllied to justify and explain the judicial review of legislation exercised by Tribunal Constitucional in portuguese constitutional reality. Eventually, we will conclude whether the legislative is constitutionally allowed to overturn Tribunal Constitutional rullings (according to portuguese constituion) and, if so, in which circumstances.
